Web Engine Network Terms & Conditions

Subject to Universal Terms of Service:
These Web Hosting Terms of Service (“Web Hosting ToS”) supplement and are subject to the Web Engine Network Universal Terms of Service (“UToS”), which are incorporated by reference. Any capitalized terms used but not defined herein shall have the meanings assigned in the UToS. In case of a conflict between these Web Hosting ToS and the UToS, these Web Hosting ToS shall prevail. -
Products:
Web Engine Network offers customers web hosting plans where customer content will be hosted on one or more of Web Engine Network’s servers (collectively, “Web Hosting Products”), as determined at Web Engine Network’s sole discretion.
Signup, Fees, and Auto-Renewal:
To activate a Web Hosting Product, customers must sign up and pay the applicable Web Hosting Product fee (“Web Hosting Product Fee”) as listed on the website. Fees will be charged before renewal and, unless otherwise specified by the customer in AMP, the service will automatically renew for the same duration as the previous term.

Product Features and Implementation:
After signing up and paying the required Web Hosting Product Fee, customers will receive information on how to access their hosting account unless they opt for Web Engine Network to manage it on their behalf. Customers acknowledge that the hardware and software resources used to provide the hosting service may be shared among multiple customers on the same servers. -
Free Hosting Accounts:
Web hosting provided as part of a web design package will include the “Standard Package.” This free hosting is offered as a special promotion and does not come with a contract or service guarantee. Web Engine Network reserves the right to delete free accounts at its discretion. Services provided under free hosting, such as email accounts and software updates, are granted at Web Engine Network’s discretion and are not guaranteed. -
Use of the Term “Unlimited”:
While Web Engine Network offers unlimited disk space and bandwidth, these services are intended solely for website hosting. The use of hosting services for online file storage, archiving, or storing data unrelated to the website is prohibited. Certain hosting plans operate on shared platforms, and if customer content negatively affects server or network performance, the customer must make necessary modifications or upgrade to a different hosting plan as determined by Web Engine Network. -
WHMCS License:
If a customer adds a WHMCS license to their Web Hosting Reseller plan, they must comply with both the WHMCS Terms of Service and the End User License Agreement, which are incorporated by reference. -
VPS and Dedicated Hosting Plans:

Virtual Private Server (VPS) Hosting: Provides dedicated resources within a Web Engine Network server, shared with other customers. Customers have full control over their private server space and software configuration.

Dedicated Server Hosting: Reserves an entire server exclusively for a customer’s use. Customers have full control over the server’s bandwidth, memory, and storage space. Orders for Dedicated Server Hosting may be subject to a Dedicated Server Service Level Agreement.

Operating System and Control Panel Licenses:

VPS and Dedicated Hosting plans may run on different versions of Linux.

Customers may request a specific Linux version, subject to Web Engine Network’s discretion.

Plans include a limited number of control panel licenses. Additional licenses can be purchased separately on a monthly basis.

Customers are responsible for adjusting their license tier as needed, as reductions will not be automatically applied.

Control Panel License Renewal:
If a control panel license add-on is not renewed (e.g., due to non-payment), it will be suspended. This does not affect the hosting plan unless the hosting plan itself is also suspended. Control panel functionality will cease until the license is renewed. cPanel licenses are only available on a monthly term and are non-refundable. -
Data Backup Responsibility:

Customers are responsible for maintaining backups of their content. Web Engine Network is not responsible for data loss during service upgrades or downgrades.

Customers are encouraged to maintain separate backup copies outside Web Engine Network’s services.

Web Engine Network offers Backup Manager for purchase, allowing for automated backups.

Email Support:
Web Engine Network does not provide additional support for email accounts, including issues related to spam, phishing attempts, or forgotten passwords. Customers must manage their own email accounts and passwords, as Web Engine Network does not store customer passwords. -
IP Address Ownership:

Any IP address assigned to a customer remains the property of Web Engine Network.

Web Engine Network reserves the right to change or remove assigned IP addresses at its sole discretion.

Unused IP addresses for 30 days may be reassigned without prior notice, though Web Engine Network may notify the customer via email.

Costs incurred in reclaiming unused IP addresses will be billed at the current administrative service rate.

Server Migration:
As part of routine business operations, Web Engine Network may migrate servers, which could result in IP address changes. Web Engine Network does not guarantee that a customer’s IP address will remain the same. -
Caching:
Customers grant Web Engine Network the right to cache all customer content. This caching does not constitute an infringement of the customer’s intellectual property. -
CPU Usage and Resource Limits:

Customers must not use excessive CPU processing power, as determined by Web Engine Network.

Violations may result in additional charges, service disconnection, or termination of agreements.

Customers are not entitled to refunds for fees paid before corrective action is taken.

Bandwidth and Disk Usage:

Web Engine Network provides ample bandwidth and disk space for business use.

Excessive use beyond the agreed-upon limits may result in additional charges, service suspension, or termination.

Customers must comply with all applicable laws regarding hosted content.

Free Product Credits:
Upon termination of services, all free products provided by Web Engine Network will be canceled. Customers will not be able to recover lost web content or emails if they migrate to another provider. -
cPanel Usage and Fair Use Policy:

Customers adding cPanel to their server must comply with the cPanel End-User License Agreement.

Web Engine Network may impose additional charges or restrict excessive cPanel usage at its discretion.

Where possible, Web Engine Network will notify customers exceeding usage limits.

Service Uptime Guarantee:

Customers on shared hosting plans may request an uptime report once every 30 days.
-
If the server’s uptime falls below 99.99%, customers may receive one month of credit upon request.

Downtime due to scheduled maintenance, force majeure events, or third-party attacks (e.g., DDoS) is not eligible for credit.
-
Interruptions caused by custom scripts, third-party applications, or customer modifications do not qualify as downtime.

Third-Party Software:
Third-party software provided by Web Engine Network is subject to its own licensing terms. Customers agree to comply with any applicable terms and conditions.
By using Web Engine Network services, customers agree to these Terms & Conditions. Failure to comply may result in suspension or termination of services.
